We actually started to argue. I asked why they hadnt rang back and was told she'd been answering the phone and couldnt really ignore them, wtf :evil:

Didnt get an answer why i paid over £2000 on the 4th only to be told today that we have to move.

Ive asked to be e mailed any better alternatives and if not Im more than happy to take my money back and look somewhere else. Any ideas just incase?

What a day ski hunting, a lorry driver gets out of his cab and threatens me and a T/O takes the piss.

mfc, post here the dates, resort, country and all the other criteria you want, and start to line up your options, in case the T/O fails to come up with the goods.

It's just not nice to be stuffed like this after you've just paid :evil:

You are right to be cross, however there are lots of T/O's out there who will want your £££, and you may even save money as a result of this fiasco.

Hi,

if you had already paid the money for the holiday, and there isn't a clause in the agreement stating you may be equired to change apartments in the event of something happening, or that the person/company reserves the right to move you, they haven't got a leg to stand on.

As far as the pool goes, they have not told a lie about having one ,but they could be liable for wrongfull advertising by not telling you it is outside (unless it is heated and is meant for all weather/and time of year use).


Once you have made payment, and have have/have not signed accepting any terms and conditions (as long as you haven't signed anything to that end) then if they want to move you they must make it worth your while and compensate you in some way.

Mind you this is all ok if the people/persons you are dealing with is a UK comany etc ,if you have booked direct with a company/or person abroad this may affect your rights as a consumer.

Tell em if they want to move you ,after you have already paid you will require a substantial discount (also check if they are ABTA registered.

A few years ago I had a trip booked to Obergurgl with a T/O, and they phoned me up to say that they'd cancelled the flight from Gatwick because they didn't have enough customers, and that we were going to have to go to Manchester instead.

I thought about it, read their conditions in the brochure, and decided that this amounted to what they described, I think, as a 'material change' to the holiday, which meant I should be able to cancel my holiday and get my money back. I phoned them, told them this, and they didn't argue about it, but gave me my money back, and I got another one with another T/O to the same place.

So I suppose it depends on how fundamental the change is, as to whether you can cancel and get your money back.

They certainly promote themselves as a cut above the rest.

I do remember they made an utter pigs ear of my booking one year. I had the presence of mind to tape the phone call of the fiasco, which I then sent to them by post.
They sent me £50

I've not been back :mrgreen:
